Terms of service
Version 2026-10-06 · Hospitality Ops Pro is operated by 9495 Creative Ltd, London, United Kingdom.
These terms are a contract between 9495 Creative Ltd and the business that opens an account ("you"). Hospitality Ops Pro is sold to businesses only; consumer protection rules for distance selling do not apply.
1. The service
We give you access to Hospitality Ops Pro on the plan you choose, hosted by us, for your sites and your team. We will keep it available at least 99.5% of each month, excluding planned maintenance announced 48 hours ahead and events outside our control.
2. Trial, plans and payment
New accounts get a 30-day free trial with no card. After that, you pay monthly in advance by card through Stripe at the price shown when you subscribe, plus VAT. Prices can change with 30 days' notice; a change takes effect at your next renewal. Extra sites are charged per site. If a payment fails we try again for 7 days, then the account goes read-only until it is settled.
3. Cancelling and refunds
You can cancel at any time from Settings. The service runs to the end of the paid month and does not renew. Our refund policy sets out when we refund.
4. Your data
Everything you put into the system belongs to you. You can export it at any time. We process it only as your processor under the Data Processing Agreement. After cancellation we keep your data for 90 days so you can export it, then delete it, except where the law makes us keep records longer.
5. What you must do
- Keep your login details secret and tell us at once if you think they are compromised.
- Only put in data you are allowed to hold, and tell your staff about the system (we give you a notice to show them).
- Check figures that matter. The system calculates pay, holiday, VAT and profit estimates from what you enter; you remain responsible for your payroll, tax returns and legal compliance. Estimates are not advice.
- Not resell the service, break its security or use it for anything unlawful.
6. What we must do
Keep the service secure and backed up, keep your data confidential, fix faults promptly, and answer support within one working day.
7. Liability
Nothing in these terms limits liability for death, personal injury or fraud. Otherwise our total liability in any 12-month period is limited to the fees you paid us in that period. We are not liable for indirect loss, lost profit, fines or penalties that arise from data you entered or decisions you took.
8. Ending the agreement
Either side can end it with 30 days' notice. We can suspend access immediately for non-payment or misuse, after warning you by email where it is reasonable to do so.
9. General
English law applies and the courts of England and Wales have jurisdiction. If part of these terms is unenforceable, the rest still stands. We may update these terms; material changes are announced 30 days ahead and shown for acceptance at your next login.
